Abstract

Imam Al-Shafi'i is one of the Imams of the Four Schools of Fiqh in Islam. Because there were so many students of Imam Al-Syafi'i, a school of fiqh was formed which was known as Madzhab Al-Syafi'i (Syafi'iyah). Apart from being a scholar who became the forerunner to the establishment of a school of fiqh, Imam AlSyafi'i was also the first founder of Ushul Fiqh science, as Aristotle was the founder of the science of logic. With his initiative and thoughts Ushul Fiqh is structured logically, critically and systematically. His thoughts in the field of Ushul Fiqh can be seen in his monumental work, Al-Risalah. This article is focused on examining the construction of Imam Al-Syafi'id ijtihad with a concept analysis approach. According to him, the arguments and sources of Islamic law are based on; a) al-quran, as-sunnah, ijma`, and Qiyas. Meanwhile in Al-Umm, he included qawl shahabah as one of the foundations of Islamic law. The construction of ijtihad that he initiated has its own characteristics, namely the combination of the manhaj ijtihad ahlu al-ra'yi and ahlu al-hadith patterns. The emergence of Imam Al-Syafi'i ended the fierce polemic from the followers of both camps. However, the legal products he produces do not contain absolute truth, because the results of ijtihad can be true or false. This is stated in his very famous statement "my opinion is right but it can be wrong and the opinion of other people is wrong but it can be true." Keywords: Al-Syafi'i, Ijtihad, Islamic Law
