Abstract
This paper aims to determine the religious understanding of the Madurese community towards the tradition of child marriage compared to Law no. 12 of 2022 concerning the Crime of Sexual Violence. In addition, it also knows the factors behind the Madurese community in carrying out the practice of child marriage. The research approach uses the social construction theory of Peter L. Berger to analyze the dynamics of child marriage in Madura, maqasid sharia as an analysis of child marriage in Madura in Islamic law and the TPKS Law as a comparison. Interviews with perpetrators, religious leaders and community leaders in several areas in Madura. The result of child marriage also includes TPKS acts in article 10 paragraph 2 that "including forced marriage in article 1, namely: a) child marriage and b) forced marriage in the name of cultural practices. Madurese people's understanding of marriage is very deep and realizes that it is very sacred and sacred In terms of the underlying factors 1) cultural factors that have been attached 2) religious factors 3) economic factors 4) social.
